Dubai Judicial Orders Builders to Pay Buyer Dh1.8m Over Unsuccessful Property Sale

A Dubai court has ordered a real estate developer to withdraw a reservation agreement for a real estate unit in The Heart of Europe project and return the buyer Dhs1.805 million plus 5 per cent yearly interest on the amount from the date of filing the legal claim until full payment is made. This was after the developer had failed to fulfilll its commitment to finalise the sale and register the apartment in the buyer’s name, although the buyer had paid all sums required.

Earlier, a buyer filed a lawsuit seeking to recover sums paid under a reservation agreement to purchase a hotel unit in the second phase of The Heart of Europe project in April 2025 for Dhs 1.651 million. The total sum paid, including fees, value-added tax and administrative expenses, was Dh1.805 million.

The buyer alleged that the developer had not signed the final sale contract and registered the unit in his name although he had fulfilled all financial obligations. The developer offered to allocate another unit instead of the one agreed upon, but the buyer refused the offer.

He likewise claimed for the loss of the expected return of his investment and the possible rise in the value of the property, stating an agreement providing for an annual investment return of 10 pc for ten years, subject to the terms thereof.

The court ruled that the failure to complete the sale and registration, despite full payment, amounted to a fundamental breach that would warrant dissolution of the agreement and a refund of the amounts received.
